A Stillman and Friedland Note with Concern To the Rising Rate of Truck Accidents in Tennessee
Fatalities linked to truck crashes have been climbing year-by-year according to statistics compiled by the Tennessee Department of Homeland Security. Nationwide, the number of fatal crashes fell steeply from 1997-2009, but recent years have seen a steady increase. Since 2011 and through 2015, Tennessee truck accident fatalities have risen from 97 to 119 per year, an increase of over 22%. During the same period, car traffic fatalities overall have decreased, but truck accident figures show a steady rate of increase. There are currently no statistics available of truck-related injuries in Tennessee, but it is reasonable to assume that rates for death and injuries rise together due to the severity of accidents when trucks are involved.
What this means for Tennesseans is that unless something changes, this truck accident trend will only continue. As we have noted in previous posts, there are tactics you can use to avoid truck collisions, mainly by being aware of the limited visibility truck drivers have, and avoiding blind spots.
However, in the event that you are involved in a truck accident, what are the key steps you need to take? It is important to remember that this is very different from a car accident. There is probably a commercial interest opposing your case in addition to the opposition from the defendant’s insurance company. Truck drivers generally have a trip log that would show how many hours the driver had been on the road on the day of the accident and other pertinent information. But unless you have an attorney who is moving quickly to gather evidence, that evidence may conveniently vanish — leaving you with much less of a case and limiting the amount of damages you can recover.
